侮辱國(guó)歌或入刑 情節(jié)嚴(yán)重者最高可判3年

10月31日，《刑法修正案(十)(草案)》提交十二屆全國(guó)人大常委會(huì)第三十次會(huì)議審議，草案擬在刑法第299條侮辱國(guó)旗、國(guó)徽罪中增加一款規(guī)定，明確侮辱國(guó)歌情節(jié)嚴(yán)重的，處三年以下有期徒刑、拘役、管制或者剝奪政治權(quán)利。

全國(guó)人大常委會(huì)審議《刑法修正案(草案)》，擬將侮辱國(guó)歌行為列入刑法處罰。

今年10月1日，《國(guó)歌法》(National Anthem Law)正式實(shí)施。其中規(guī)定應(yīng)當(dāng)奏唱國(guó)歌的場(chǎng)合包括：黨和國(guó)家機(jī)關(guān)的重大會(huì)議(major sessions of the Party and the nation)、重大儀典(major celebrations)、重大外交活動(dòng)(important diplomatic occasions)及重大體育賽事(major sport events)，還有舉行升國(guó)旗儀式的時(shí)候(flag raising ceremonies)。同時(shí)，明確了不得奏唱國(guó)歌的場(chǎng)合，即不得用于商標(biāo)和商業(yè)廣告，不得在私人喪事活動(dòng)等不適宜場(chǎng)合使用("inappropriate" private occasions)，不得作為公共場(chǎng)所的背景音樂(lè)(background music in public places)等。同時(shí)，《國(guó)歌法》也規(guī)定了侮辱國(guó)歌行為的處罰方式。

全國(guó)人大常委會(huì)法制工作委員會(huì)副主任王超英介紹，國(guó)歌(national anthem)和國(guó)旗(national flag)、國(guó)徽(national emblem)一樣，都是國(guó)家的象征和標(biāo)志。為了依法維護(hù)國(guó)旗、國(guó)徽的尊嚴(yán)，懲治侮辱國(guó)旗、國(guó)徽的犯罪行為，刑法第299條規(guī)定了侮辱國(guó)旗、國(guó)徽罪，明確了刑事責(zé)任(criminal responsibility)?！秶?guó)歌法》通過(guò)后，有必要對(duì)刑法第299條作相應(yīng)補(bǔ)充，明確侮辱國(guó)歌行為的刑事責(zé)任。

為此，刑法修正案(十)草案在第299條中增加一款規(guī)定為，在公共場(chǎng)合，故意篡改中華人民共和國(guó)國(guó)歌歌詞、曲譜(maliciously modify the lyrics and music)，以歪曲、貶損方式奏唱國(guó)歌(play or sing the national anthem in a distorted or disrespectful way)，或者以其他方式侮辱國(guó)歌，情節(jié)嚴(yán)重的，處三年以下有期徒刑(up to three years of imprisonment)、拘役(criminal detention)、管制(criminal control)或者剝奪政治權(quán)利(deprivation of political rights)。

《刑法》第二百九十九條 【侮辱國(guó)旗、國(guó)徽罪】

在公眾場(chǎng)合故意以焚燒、毀損、涂劃、玷污、踐踏等方式侮辱中華人民共和國(guó)國(guó)旗、國(guó)徽的，處三年以下有期徒刑、拘役、管制或者剝奪政治權(quán)利。

Whoever purposely insults the national flag, national emblem of the PRC in a public place with such methods as burning, destroying, scribbling, soiling, and trampling is to be sentenced to not more than three years of fixed-term imprisonment, criminal detention, control or deprived of political rights.
