“搶奪方向盤、毆打駕駛員”屬以危險(xiǎn)方法危害公共安全

近日，最高人民法院、最高人民檢察院和公安部聯(lián)合印發(fā)了《關(guān)于依法懲治妨害公共交通工具安全駕駛違法犯罪行為的指導(dǎo)意見》，進(jìn)一步提升對(duì)公共交通安全秩序的法律保障力度。

According to the guide, passengers who grab devices such as steering wheel or gear shift lever, and conduct actions that hamper safe driving such as beating or dragging drivers should be punished for crime of endangering public security with dangerous method. The passengers should not be granted probation even if the actions did not result in grave consequences. If passengers attack drivers with instruments, they should be given severe punishment.

意見明確，對(duì)于乘客實(shí)施“搶奪方向盤、變速桿等操縱裝置，毆打、拉拽駕駛?cè)藛T”等具有高度危險(xiǎn)性的妨害安全駕駛行為的，按以危險(xiǎn)方法危害公共安全罪定罪處罰，并強(qiáng)調(diào)即使尚未造成嚴(yán)重后果，一般也不得適用緩刑;具有“持械襲擊駕駛?cè)藛T”等幾類特定情形的，予以從重處罰。

乘客針對(duì)其他人員實(shí)施尋釁滋事行為(causing disturbances)，妨害交通運(yùn)營(yíng)秩序、影響行車安全的，根據(jù)具體情況分別適用尋釁滋事罪或者以危險(xiǎn)方法危害公共安全罪定罪處罰(crime of endangering public security with dangerous method)。

《意見》強(qiáng)調(diào)，以暴力、威脅方法阻礙國(guó)家機(jī)關(guān)工作人員依法處置妨害安全駕駛違法犯罪行為、維護(hù)公共交通秩序的，以妨害公務(wù)罪定罪處罰(crime of endangering public affairs);暴力襲擊正在依法執(zhí)行職務(wù)的人民警察的，從重處罰。

For drivers who are unable to resolve disputes with passengers in a sensible way and leave their post to clash with passengers, they should be punished for crime of endangering public security with dangerous method.

鑒于實(shí)踐中少數(shù)駕駛?cè)藛T與乘客發(fā)生紛爭(zhēng)后不能理性應(yīng)對(duì)，而是違規(guī)操作或者擅離職守與乘客發(fā)生沖突，《意見》規(guī)定對(duì)實(shí)施此類行為的駕駛?cè)藛T按以危險(xiǎn)方法危害公共安全罪定罪處罰。

此外，為鼓勵(lì)公共交通工具的乘務(wù)人員和乘客與妨害安全駕駛違法犯罪行為作斗爭(zhēng)(stand up against criminal offenses)，及時(shí)制止侵害駕駛?cè)撕统丝偷男袨?，采取緊急措施避免嚴(yán)重危害后果發(fā)生(stop actions that could cause serious consequences)，《意見》還就正當(dāng)防衛(wèi)(justifiable defense)、緊急避險(xiǎn)(emergency measures)作出了原則規(guī)定。
