7.1 Agree to Settle a Claim 答應(yīng)對(duì)方索賠

M: The consignments of chemical instruments have just reached us. We have to lodge a claim against you for inferior quality I am afraid.

W: Is there anything wrong?

M: We bought 1,000 sets of chemical instruments from you, but there are 40 not up to the standard.

W: It's hard for us to believe it. Our instruments have been the best quality for years. Have you any reliable evidence?

M: Here is the survey report from a well-known public surveyor in London. You may inspect the defective instruments personally

W: Well. According to the contract, we are responsible for repairing or replacing those defective instruments. We’ll send our technicians to repair them.

M: Forty faulty instruments means that 4% are not up to the standard. You should compensate us for 4% of the total account on the contract, as well as for the inspection fee.

W: I am sorry about the quality problem, but I propose we compensate you for 3% of the total value apart from the inspection fee.

M: All right. In that case we are still willing to do business with you.

M：我們剛剛已經(jīng)收到化學(xué)儀器了，恐怕我們不得不就這些產(chǎn)品較差的質(zhì)量向你方提出索賠。

W：有什么不對(duì)的么？

M：我們從你處購(gòu)買了1000套化學(xué)儀器，但是有40套是不合格產(chǎn)品。

W：我們很難相信會(huì)這要交們的儀器多年來(lái)質(zhì)量一直很好，你有什么可靠的證據(jù)嗎？

M：這是一家倫敦的權(quán)威機(jī)構(gòu)的檢測(cè)報(bào)告，你們也可以親自對(duì)這些次品進(jìn)行檢查。

W：好吧，根據(jù)合同，我們要對(duì)這些殘次品進(jìn)行修理和調(diào)換，我們會(huì)派技術(shù)人員去修理。

M：40套不合格產(chǎn)品意味著4%的不合格率，你們應(yīng)該向我們賠償合同總價(jià)值的4%，還包括調(diào)查費(fèi)。

W：對(duì)于質(zhì)量問(wèn)題我表示歉意，但是我提議我方除了賠償調(diào)查費(fèi)外，再賠償合同總價(jià)值的3%。
